had a significant impact on importers. A much greater burden has been placed on the importer in the areas
of informed compliance, and record keeping. Increasing numbers of importers are being audited and finding
that they have not been in compliance with customs regulations in the past. Non-compliance with these regulations
can lead to fines and penalties that can reach as much as $10,000 per entry. Finding, correcting, and reporting
these problems before Customs does, illustrates the use of proper care, and helps to protect against penalties.

Classification
How was the classification of your merchandise determined? Using the alphabetical index of the Harmonized
Tariff Schedule is not sufficient. It is imperative to follow the guidelines set forth in the General Rules
of Interpretation. In addition, it is necessary to consult previous Customs rulings, and possibly request a
binding ruling for your merchandise if there is any question as to the proper classification.
Valuation
Are you paying duty based on the invoice value? It is important to use the proper methods for determining
the net-entered value of your shipments. The invoice is just the beginning, you must than add and or deduct
amounts, for such items as freight, assists, rebates, royalties, etc.
Record Keeping
