U.S. Customs Modernization Act (MOD ACT)
In 1993 the U.S. Customs Modernization Act (MOD ACT) was passed. The passage of these new regulations
has had a significant impact on importers. A much greater burden has been placed on the importer in
the areas of informed compliance, and record keeping. Increasing numbers of importers are beingaudited
and finding that they have not been in compliance with customs regulations in the past. Non-compliance
with these regulations can lead to fines and penalties that can reach as much as $10,000 per entry.
Finding, correcting, and reporting these problems before Customs does, illustrates the use of proper
care, and helps to protect against penalties.
