FDA Prior Notice Requirements

October 10, 2003

Under the Public Security and Bioterrorism Preparedness and Response Act of 2002, it is required that advance notice of an import be submitted to FDA. 

Submissions can be done through the Automated Broker Interface (ABI) or through the FDA website. Submissions can not be made earlier that 5 days in advance of arrival, but must be made as follows:
  • 2 hours before arrival by land by road
  • 4 hours before arrival by air or by land by rail
  • 8 hour before arrival by water
It is more important than ever that we receive your import documents in advance of arrival to comply with these new regulations.

Failure to comply with the prior notice regulations will result in the seizure and exam of your merchandise, with the possibility of criminal charges.
